This Agreement contains terms and conditions which apply to your participation as a Webmaster of the CurnosoffCash Affiliate Program (hereinafter called the "Program"). As used in this Agreement, "you" or "your" means the applicant/participating Webmaster.
Before you can become a participant in the Program you must first read and accept each and every term of all of the following terms and conditions. By submitting a signup form for enrollment in the Program you are affirmatively stating that you have read and understand the Terms and Conditions and affirmatively indicating your acceptance of this Program Agreement.

1. We grant to you the non-exclusive right to direct, refer or send visitors or users of Your Website to websites owned, operated or controlled by Program and its owner.

2. We grant to you the limited, non-exclusive, nontransferable and revocable license, during the term of this Agreement, to use graphics, including banners, text, audio and visual content and other intellectual properties (hereinafter "marks") owned by us for the sole purpose of marketing, advertising and promoting Program 's Site(s). The license herein granted shall automatically and immediately cease upon the termination of this Agreement. 

3. You must be at least 18 years of age (or 21 years of age where 21 is the age of majority in your country/state) to signup or use the Program.

4. You warrant to us that You will not copy or reproduce, alter, modify or change, broadcast, distribute, transmit or disseminate any banners or other promotional materials provided by us pursuant to this Agreement and the Program in whole or in part, in any manner, at any time anywhere in the World.

5. You warrant to us that you will ONLY use Promotional Pictures, Images, Texts, Audio and Video content provided by us to promote and advertise websites that are included in the Program. Otherwise your account will be terminated, funds will be voided and violators will be prosecuted according to Intellectual Property Law. 

6. Unsolicited Commercial Emails and SPAM ARE NOT ALLOWED! The Webmaster of Program does no promote it by spamming in anyway! We will withhold all funds and delete accounts of Webmaster believed to be involved in spamming or abusing the Program. Spamming includes (but not limited to): newsgroups, unwanted e-mail, AOL Instant Messenger, ICQ, IRC, or any other forms of promotion we consider unlawful. 

7. Linking from illegal sites not permitted and all accounts will be terminated and any amounts owed will be voided. 

8. Webmaster trying to cheat the Program will be removed promptly. Webmaster sending fake clicks, spamming (as defined above) and/or participating in credit card fraud will result in termination from the Program, as well as being reported to the proper authorities (Federal Law Enforcement, FBI, Interpol, etc.) 

9. Any misrepresentation of our site(s), including (but not limited to) misrepresenting the cost of membership, terms of membership, or content contained within our site(s) and exploitation of our terms and conditions, instructing the member to signup and cancel is not permitted in any way. 

10. KurnosoffCash will pay 50% of every signup and 50% of recurrent billing for the life of the member. 

11. For purposes of promotion our Program we offers an opportunity to refer webmasters to us and to receive a commission on the resulting sales. We pay 5% from each sales of referred webmaster (available for Multi-processing cascade mode only).

12. We use 3rd party billing companies’ stats to track and report sign ups to the Program. All sign ups are tracked and verified through 3rd party billing companies. The Webmaster is responsible for charge backs and/or refunds based off the report from 3rd party billing company. 

13. Credit Card & Debit Card & online Check Transactions the Operator of Program will remit payout payment bi-monthly, monthly, on custom period or on custom payment amount level base or by request with a three and a half weeks delay. While the Operator of Program will make all reasonable efforts to issue payment on the 12th and the 27th, unusual circumstances (such as holidays or bank network failures) may delay payments, in which case the Operator of Program will make payment the next business day.

14. Due to existing Billings Chargeback and Refund fees Webmaster's account is a subject for follow possible adjustments: 

14.1 Fees for Credit Card Services Chargebacks. Webmaster shall be charged $15 X Webmaster's percentage share fee per chargeback for Credit Card and Debit Card transactions, and $5 X Webmaster's percentage share fee per chargeback for Check. There is no chargeback fee for web 900 service transactions. There is no chargeback fee for online check transactions. Webmaster must maintain a chargeback ratio of less than 1% of transaction value and maintain a Customer Credit ratio of less than 5%. Charge backs that reach over 1% and/or Customer Credits that reach over 5% will be subject to a higher chargeback fee, holding of funds, increased fees and/or cancellation. You understand that the Operator of Program reserves the right to delay, suspend, or refuse payment of any portion of your account balance at any time for any of the above agreement violations. You understand that the Operator of Program reserves the right to close your account at any time for any of the above agreement violations. 

14.2 Fees for Credit Card Services Refunds. Due to current 3rd party billing policies Webmaster's account shall be charged with follow amount for each Refund:
$2.00 X Webmaster's percentage share per refund issued against Webmaster's account.

This Payouts payment policy is in effect to provide ample time for the Operator of Program to detect and protect itself against potential fraudulent transactions and due to current 3rd party billings policies.

15. Minimum Payment. Webmaster payout payment shall only be processed when the payout amount due at the end of a payout period exceeds $99. If the payout amount due at the end of a payout period is less than $99, payout shall be held over to the end of succeeding payment periods, until such time as the accumulation of the Webmaster 's payout amount exceed $99. 

16. Payment methods. Due to our European location a payout amount will be sent to Webmaster via SWIFT wire transfer as default method. There will be a charge of $20 against Webmaster's account for each wire transfer made. This fee cover payer bank commission and commission of its corresponding bank only. Webmaster shall be responsible to indicate correct banking details for wire transfer. Also we can pay you by follow methods: Fethard, Webmoney. These payments are made through our partners so we do not guaranteed you that we will offer such services everytime.
The Operator of Program does not cover any costs and expenses in the case of payments to incorrect details indicated by Webmaster.

17. We notice You that You and Affiliate Program are independent contractors only. No partnership is being created pursuant to the Agreement and there are no any partnership liabilities between You and Affiliate Program. 

18. Failure to utilize the correct linking codes could result in lost hits and uncounted sign ups. KurnosoffCash is not responsible for incorrect linking codes. 

19. We cannot be held responsible for loss of monies or clicks due to downtime or damages resulting from complications with our hosting providers, riots, acts of god, server based problems or any other issues that may arise. 

20. As a KurnosoffCash Webmaster, you will receive KurnosoffCash news and update information. You are not allowed to unsubscribe from this newsletter during your participation in our Program. 

21. We reserve the right to terminate any agreement at any time, for any reason, without prior notification. In such cases you will be notified immediately. 

22. We reserve the right to change terms of Program, at any time without notification. If we make major changes, we normally send out an email to all KurnosoffCash Webmasters.
